What is Sale deed?

The document that actually transfers ownership. Registered at the sub-registrar office after stamp duty is paid.

How it works and what to check

The sale deed is the registered document by which the seller transfers ownership to the buyer. In India a sale of immovable property worth ₹100 or more transfers ownership only through a registered instrument, so an unregistered sale deed does not make you the owner.

It names the parties, describes the property with its boundaries and survey or flat number, states the price and how it was paid, and recites how the seller came to own it. Stamp duty is paid on it and it is registered before the sub-registrar with two witnesses.

Keep the original. Lenders hold it during a loan, and later buyers will ask for it as part of the chain of title.

Common questions

What is the difference between a sale deed and an agreement to sell?

An agreement to sell is a promise to transfer later on agreed terms; it does not transfer ownership. The registered sale deed is the transfer.

What is a registry in north India?

In everyday speech in north India, 'registry' means the registered sale deed.
