Rent agreement registration: when it is required and how to do it

Whether a rent agreement must be registered depends on its length and on your state. This guide explains the Registration Act rule behind eleven-month agreements, Maharashtra's rule for leave and licence agreements, the newer state tenancy laws, how stamp duty and registration are paid, and when registering is worth doing even if it is optional.

The short answer

Under the Registration Act, 1908, a lease of immovable property from year to year, for any term exceeding one year, or reserving a yearly rent must be registered. An agreement for eleven months is outside that rule, so in most states it is stamped and signed but not registered. Stamp duty is payable on every rent agreement, registered or not, at the rate your state sets.

There are important exceptions. In Maharashtra, section 55 of the Maharashtra Rent Control Act, 1999 requires every leave and licence agreement to be registered, whatever its length, and the state offers online registration. States that have adopted the Model Tenancy Act, 2021 or their own new tenancy law may also require the agreement to be reported to a rent authority. Check the law of your state, and the stamp duty page for your state, before you sign.

What the law says

Section 17(1)(d) of the Registration Act, 1908 makes registration compulsory for leases of immovable property from year to year, for any term exceeding one year, or reserving a yearly rent. Section 107 of the Transfer of Property Act, 1882 says such leases can be made only by a registered instrument.

If a document that had to be registered is not registered, section 49 of the Registration Act says it cannot be used as evidence of the lease itself, though courts allow it to be used for limited collateral purposes. In practice, an unregistered long lease leaves both sides in a weak position if there is a dispute about the term, the rent or the deposit.

Leases of one year or less are not compulsorily registrable under the Registration Act. That is the origin of the eleven-month agreement: it stays clear of the one-year line with a margin, and many landlords and tenants prefer to renew on fresh paper each year rather than register.

Maharashtra: leave and licence agreements

In Maharashtra, homes are usually let under a leave and licence agreement, which gives the licensee permission to occupy rather than a tenancy. Section 55 of the Maharashtra Rent Control Act, 1999 requires every such agreement made after the Act came into force to be in writing and registered, and puts the responsibility on the landlord. If the agreement is not registered, the Act says the licensee's version of the terms will prevail in a dispute unless proved otherwise, and it provides a penalty for the landlord.

The Department of Registration and Stamps offers online registration of leave and licence agreements: the parties fill in the details online, pay the stamp duty and registration fee electronically, and authenticate with Aadhaar-based identification, so a visit to the sub-registrar's office is often not needed. Many authorised service providers handle the process for a fee. Our leave and licence format follows the usual Maharashtra structure.

The newer tenancy laws

The Model Tenancy Act, 2021 was circulated by the Ministry of Housing and Urban Affairs for states to adopt. It requires a written tenancy agreement and requires the landlord and tenant to inform the rent authority of the agreement within the time it sets, after which the authority issues a unique identification number. It also caps the security deposit and sets up rent authorities, rent courts and rent tribunals.

The model text applies only in a state that adopts it, and states adapt it. Uttar Pradesh enacted the Uttar Pradesh Regulation of Urban Premises Tenancy Act, 2021, and Tamil Nadu has the Tamil Nadu Regulation of Rights and Responsibilities of Landlords and Tenants Act, 2017, which requires tenancy agreements to be registered with the rent authority. Other states have their own rent control laws, older or newer. Read your state's notified law, not the model text, and check whether the rent authority accepts filings online.

Stamp duty: payable either way

Every state charges stamp duty on leases and licences under its own stamp law. The amount usually depends on the term, the rent and any deposit or premium, and some states charge a fixed amount for short residential agreements. We do not quote rates here because they differ widely and change; check the stamp duty page for your state and the state's own portal.

Pay before you sign. Many states sell e-stamp certificates online or through authorised centres; in states using the Stock Holding Corporation of India's e-stamping system, the certificate can be verified on its website. Some states also allow franking at banks or stamp paper from licensed vendors, and Maharashtra accepts payment through its GRAS portal. An agreement that is not properly stamped cannot be admitted in evidence until the deficit and a penalty are paid.

How to register, step by step

1. Draft the agreement in full: names and addresses as on identity documents, the property address, rent, deposit, term, notice period, escalation, maintenance and repairs, and a schedule of fittings. 2. Pay stamp duty at your state's rate. 3. Book an appointment at the sub-registrar's office for the area where the property is, or start the online process where your state offers it. 4. Attend with both parties, or their authorised representatives, and two witnesses, with original identity documents, photographs and the property document or tax receipt; pay the registration fee. 5. The sub-registrar records the document, takes photographs and biometrics where the state requires it, and returns the registered copy.

Section 23 of the Registration Act allows four months from execution for a document to be presented for registration. Do not leave it that long; register before the tenant moves in.

Documents to carry

For the landlord: identity proof, PAN, and proof of ownership such as the sale deed, the property tax receipt or the society share certificate. If someone signs for the landlord, a power of attorney authorising it.

For the tenant: identity proof, address proof and photographs. Both sides need two witnesses with their own identity documents, the stamped agreement, and the receipt or challan for the stamp duty and registration fee. Check the sub-registrar's or portal's list beforehand; offices refuse incomplete sets.

Should you register an eleven-month agreement anyway?

You can. Registering an agreement that does not strictly need it puts it on the public record, makes it strong evidence of the rent, deposit and term, and can make later disputes easier to settle. The costs are the registration fee and a visit or online process.

Many landlords and tenants instead sign and notarise. Notarisation only attests that the people signing are who they say they are; it does not register the document and is not a substitute where registration is required. It does no harm, but do not mistake it for registration.

For a commercial lease of more than a year, registration is not optional. Unregistered long commercial leases cause the most serious disputes, because the lock-in and escalation clauses may not be enforceable as written.

Treating notarisation as registration.

Renewing by carrying on after the term ends, instead of signing a fresh stamped agreement.

Common questions

Is registration of a rent agreement compulsory?

Why are rent agreements made for 11 months?

Is a notarised rent agreement valid?

A properly stamped and signed eleven-month agreement is valid without registration outside Maharashtra. Notarisation attests signatures; it does not replace registration where the law requires it.
