What a PG legally is
A paying guest arrangement is usually a licence to occupy a bed or a room together with services — food, cleaning, wifi — rather than a lease of a property. That distinction matters: a licensee has contractual rights under the agreement signed, while a tenant has the additional protection of tenancy law.
Many states and municipal corporations now require PG and hostel operators to register or hold a licence, and impose conditions on safety, sanitation and the number of occupants per room. Ask whether the operator is registered and under which rule.
Get it in writing
Even a one-page agreement should record the monthly charge, what is included, the deposit, the notice period, the lock-in if any, the refund rule and the house rules.
Beware of a verbal deal with a one-month deposit and no paper. When it goes wrong there is nothing to point at.
Deposits and refunds
Ask what triggers a deduction and when the refund is paid after you leave. A refund promised 'after the room is filled' is not a refund policy.
Pay by bank transfer or UPI so there is a record. Cash with no receipt is the single most common reason PG deposits are lost.
Safety and conditions you can insist on
A working lock on your room and on the main gate, a lit and unobstructed exit, fire extinguishers where the local rules require them, clean drinking water and a sanitary kitchen if food is provided.
Reasonable privacy. An operator may set house rules and entry timings, but entering an occupied room without notice, confiscating belongings or holding identity documents is not something a house rule can authorise.
Restrictions that discriminate on religion, caste, marital status or region are not enforceable and should be reported to the operator's licensing authority.
Leaving
Serve the notice in writing and keep proof. Photograph the room and the meter on the day you leave and email the set to the operator so it is dated.
If a deposit is withheld without a stated reason, write once asking for the itemised deduction. Most disputes end there; where they do not, the consumer forum handles service complaints of this kind.
Common questions
Is a PG resident a tenant?
Usually a licensee rather than a tenant, because the arrangement bundles services with the room. Your rights come mainly from the agreement you sign, which is why having one in writing matters.
Can a PG operator keep my ID card?
No. Taking a copy for records is normal; retaining your original identity document is not.
Can a PG evict me without notice?
Not lawfully, outside a genuine emergency. The notice period in the agreement governs, and you are entitled to remove your belongings.
